Over a year ago, a group of concerned Saskatchewan citizens filed a court application, challenging the provincial government and SaskPower over building new gas-fired power plants when the federal government’s goal is to have the electrical grid at net-zero by 2035. Last month, the Saskatchewan Environmental Society applied in Regina Court of King’s Bench, to have intervenor status. Spokesperson for the group, Harold Pexa, says, ” I think with the witnesses they are planning to call evidence from, if they are granted intervenor status, they will add a lot to the understanding of the court, as to what can be done conceivably, in Saskatchewan, to get our power generation to net zero, practically in the required time.” Pexa points out the the SES has a long history, going back to 1970, which pre-dates both the federal and provincial environmental departments.
He explains that the court application was started to compel SaskPower to come up with and implement a net-zero 2035 plan for their power generation, “and I think what precipitated that was SaskPower’s ongoing plan to build new, unabated gas-fire generation.” There are no timelines at this point for a decision on the intervenor status or a decision on the provincial government’s request for the court application to be dismissed.

This began in March of last year when the group asked the court to consider whether it is a violation of the Charter rights to life, liberty and personal security when SaskPower builds new gas generation plants, in light of climate change. The court order asks the Crown Corporation to develop a realistic plan to achieve net-zero emissions by 2035.
The government has asked for a dismissal of the lawsuit.
Friday’s hearing will address whether the Saskatchewan Environmental Society should be granted status as an intervenor. If the application is approved, the SES intends to provide evidence on the impacts of the provincial government and SaskPower’s decisions have made on the environment, and achievable options on how net-zero greenhouse gas emissions can be reached.

The court order asks for the Crown Corporation to develop a realistic plan to achieve net-zero emissions by 2035.
A year later, on April 5th of 2024, there will be a special hearing to consider whether the case should go ahead. The organization called Sustainable Saskatchewan says on its website that the government has asked for a dismissal of the lawsuit. Both the government and SaskPower made applications to strike the case. It’s anticipated their court materials will be served by February 5th and the group’s response for court will be ready by March 5th.

This time it’s the government’s climate change inaction and perverse promotion of fossil fuel interests.
The applicants filed suit in March, arguing that the government’s plan to expand gas-fired electricity generation violates s.7 of the Charter and Rights and Freedoms which guarantees the right to life, liberty and personal security. Saskatoon, SK. The current provincial Management and Reduction of Greenhouse Gas Regulations permit SaskPower to increase its greenhouse gas (GHG) emissions, thereby accelerating dangerous climate change. Saskatchewan has the highest GHG emissions per capita in Canada and according to the Supreme Court of Canada and our Saskatchewan Court of Appeals, we face an existential threat to the future of all life on this planet caused by ongoing GHG emissions.
Dangerous climate change is upon us and is made worse by these inexcusable actions by our government and SaskPower. The applicants argue our Charter rights are violated and that the government has a duty to mitigate its emissions. The applicants are asking the Court to order SaskPower to set a reasonable target to decarbonize and achieve Net-zero emissions as soon as possible.
This Court application should provide helpful clarification for all parties and spur important dialogue about our shared power future.
